In a case involving the assault of a man’s sister in R. Hulhudhuffaaru, the court halted proceedings after the Prosecutor General’s Office (PGO) withdrew the case following a plea-type advisory agreement with the defendant.

The case concerned an incident on January 8 this year, in which the man kicked his sister, threw her to the ground, and assaulted her at around 10:30 pm. Based on the medico-legal report issued by the health centre and witness testimony, the prosecution initially charged him with assault under the Penal Code.

However, the PGO later decided to issue an advisory to the accused instead of pursuing prosecution, as permitted under the Criminal Procedure Act. On August 31, the prosecution and the defendant signed an advisory-release agreement. The PGO requested the court to withdraw the case, noting that the matter could be reopened if any condition of the agreement was violated.

Following the prosecution’s request, the court adjourned the trial and ordered the case to be returned to the PGO along with all related documents.
